Introduction

Zyme Solutions, Inc. (“Zyme”) is committed to protecting the privacy of individuals who visit Zyme’s website, customers of Zyme’s services (“Customers”), and distributors, resellers, and other channel sales partners of Customer’s (each referred to herein as a “Channel Sales Partner”). This Privacy Policy describes Zyme’s privacy practices in relation to personal information Zyme receives through any medium.

EU-US and Swiss-US Privacy Shield Frameworks

Zyme complies with the EU-US and Swiss-US Privacy Shield Principles as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from Switzerland and European Union member countries. Zyme has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Zyme has further committed to refer unresolved privacy complaints under the EU-US and Swiss-US Privacy Shield Principles to BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.

Information Collected

Zyme collects point-of-sale, inventory, incentives claim data, and other similar data (collectively, "Transaction Data") for its Customers around the world. The Transaction Data may be submitted to Zyme by a Customer or by a Channels Sales Partner via Zyme’s portal or other means. In order to provide some of Zyme’s services, Zyme maintains a database of Channel Sales Partners referred to as the Zyme Global Channel Directory (“GCD”). The information in the GCD is limited to business information of Channel Sales Partners such as the address and website of the Channel Sales Partner. The GCD may contain personal information where business contact information includes such personal information.

Through the use of common information-gathering tools such as cookies and third party analytics services, when you navigate Zyme’s website or use Zyme’s services, Zyme may collect your IP address and information about your usage, including the pages you view, the links you click, and the actions you take (“Usage Information”).

When registering to use Zyme’s services as a Customer, registering as a Channel Sales Partner, expressing interest in obtaining information about Zyme’s services, or applying for a job on Zyme’s website, you may voluntarily submit personal contact information, such as your name, company name, phone number, and e-mail address (“Personal Contact Information”). When purchasing Zyme’s services, Zyme may require information such as billing contact and address and other information necessary for billing or other company information necessary to provide the services, and Channel Sales Partners may provide information about their company when registering on Zyme’s portal (“Company Information”).

Use of Information Collected

Zyme uses the Company Information submitted to Zyme by Channel Sales Partners to maintain the GCD. Zyme uses the GCD and Transaction Data to provide its services to Customers. Zyme does not share Transaction Data with any party except for the Customer to which such data pertains and the Channel Sales Partner from which such data was received. Zyme may share Personal Contact Information of Channel Sales Partner users with its Customers who have an existing relationship with such Channel Sales Partner. Zyme does not share Personal Contact Information of Channel Sales Partners with any other third party.

Zyme may use Personal Contact Information to communicate with Customers and Channel Sales Partners in relation to Zyme’s services to its Customers, address technical issues, and respond to support requests. Zyme may use Personal Contact Information entered on its website to send you information requested. If you opt in for further information, Zyme may send you further information about Zyme’s services, promotions, or events. You may opt out of receiving this information at any time by clicking the “unsubscribe” link at the bottom of Zyme’s emails. Zyme will not share Personal Contact Information entered into Zyme’s website with any third party unless you specifically opt in to the sharing of Personal Contact Information with that third party. Personal Contact Information provided by job applicants will be used solely in relation to the recruiting and hiring process. Zyme may use Company Information for purposes of billing for services purchased and for purposes of providing purchased services or offering additional services.

Zyme uses Usage Information to analyze general trends in traffic and improve the experience of visitors to Zyme’s website and users of Zyme’s services.

Zyme may share Transaction Data and Personal Contact Information of Customers and Channel Sales Partners with subcontractors who provide translation services for Customers. The subcontractors will only use Transaction Data to the extent translation of such data is needed and will only use Personal Contact Information of Customers and Channel Sales Partners for purposes of providing Zyme’s services, such as resolving technical issues and communicating errors in the data. Zyme’s subcontractors are required to protect your information in a manner at least as restrictive as Zyme. Zyme does not share Personal Contact Information with any other third parties. Pursuant to the EU-US and Swiss-US Privacy Shield Principles, Zyme would potentially be liable in the event of onward transfer of an EU individual’s data to a third party.

Zyme may, where it concludes it is legally obligated to do so, disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Data Security

Zyme maintains ISO 27001 compliance and takes appropriate security measures to protect against unauthorized access, alteration, disclosure or destruction of all forms of data it processes and holds. These measures include firewalls and encryption; internal controls and external audits of Zyme’s data collection, storage and processing practices, and security measures; as well as physical security measures to guard against unauthorized access to systems. Zyme limits information access to those persons in the organization who have a business need to process or handle such information.

Updating or Deleting Your information

Zyme acknowledges the right of individuals to access their personal data. Customer users may update their Personal Contact Information by logging into apps.zymesolutions.com and clicking on “Edit Profile Details.” Customer users may have their registration deleted by emailing This email address is being protected from spambots. International Transfer

To facilitate Zyme’s global operations, your information may be transferred to, and processed in, the United States or any other country in which Zyme maintains operations.

Changes to the Policy
